Privacy Policy

Offbeat Boudoir’s Privacy Policy

1. Who We Are

Offbeat Boudoir ("we," "us," "our") is a boudoir photography business operated by Regina as The Photographer / Offbeat Boudoir in Tampa, Florida. This policy explains what personal information we collect when you visit www.offbeatboudoir.com (the "Site"), contact us, or book and complete a photo session with us (the "Services"), and how we use, store, and protect it.

By using the Site or booking our Services, you agree to this policy. If you don't agree, please don't use the Site.

2. Information We Collect

Information you give us

  • Contact and inquiry details: name, email, phone number, and your message when you fill out a contact or booking form or email us.

  • Booking details: session type, preferred dates, wardrobe or styling preferences, and anything you choose to tell us about your session goals.

  • Newsletter signup: your name and email address if you subscribe to our emails.

  • Contracts and releases: signed session agreements and any model release you choose to sign.

  • Payment information: processed by our third-party payment provider, Stripe and Square. We do not see or store your full card number.

Photographs and session content

If you book a session, we create photographs of you. Boudoir images are intimate and personal, and we treat them as highly sensitive. We also keep related files such as proofs, edits, gallery selections, and order records.

Information collected automatically

When you visit the Site, we and our service providers may automatically collect technical data such as your IP address, browser and device type, pages viewed, referring page, and approximate location. This is collected through cookies and similar technologies (see Section 6).

3. How We Use Your Information

We use your information to:

  • Respond to inquiries and schedule, prepare for, and deliver your session;

  • Edit, deliver, and sell your images, and process payments;

  • Send session reminders, gallery notices, and service-related messages;

  • Send marketing emails, only if you opted in, and you can unsubscribe at any time;

  • Operate, secure, and improve the Site and understand how visitors use it;

  • Keep business, tax, and legal records and enforce our agreements; and

  • Comply with the law.

We do not sell your personal information.

4. Your Images: Privacy, Ownership, and Use

We know that trusting a photographer with intimate images takes real confidence, so we're specific about how we handle them.

  • Copyright. Unless your session agreement says otherwise, we retain copyright in the photographs we create, and you receive a license to use the images you purchase as described in your agreement.

  • No public use without your written permission. We will not post, publish, advertise, enter into contests, or otherwise display your boudoir images, in whole or in part, unless you have signed a model release that says so. A model release is optional, and declining it will never affect the quality of your session or your images.

  • Private galleries. Your images are delivered through a private, password-protected gallery. Please don't share your gallery link or password if you want the images to stay private.

  • Who can see them. Only Regina / authorized staff such as an assistant or editor, if any and the service providers we need to store, edit, and deliver your images can access them. Anyone who works with your images is required to keep them confidential.

  • Unselected and unpurchased images. We archive the jpeg files for up to 2 years after your gallery goes offline. After that, all files will be deleted.

5. How We Share Information

We share personal information only as needed to run our business, and only with:

  • Service providers who help us operate, such as our website host Squarespace, email and newsletter provider (Squarespace), online gallery and cloud storage provider Pixieset, scheduling or CRM tools Tave, payment processors, and analytics providers. They may use your information only to perform services for us.

  • Legal and safety reasons, if we believe disclosure is required by law, subpoena, or court order, or is necessary to protect rights, safety, or property.

  • Business transfers, if our business is sold or reorganized, in which case this policy and your privacy choices will continue to apply to your information.

  • Anyone you direct us to, for example, if you ask us to send images to a printer or another vendor.

We do not sell or rent your information or your images to anyone.

6. Cookies and Analytics

The Site uses cookies and similar tools to make it work, remember preferences, and understand traffic. We use Google Analytics to see how visitors use the Site. These tools may collect data such as your IP address, pages viewed, and device information. You can control or delete cookies in your browser settings, and you can opt out of Google Analytics using Google's browser add-on at tools.google.com/dlpage/gaoptout. Blocking some cookies may affect how the Site works.

Some browsers send "Do Not Track" signals. Because there is no common standard for these, the Site does not currently respond to them.

7. Social Media and Third-Party Links

The Site may link to or embed content from third parties such as Instagram, Facebook, or Pinterest. Those services have their own privacy practices, and we're not responsible for them. We encourage you to read their policies. If you tag or message us on social media, that content is also governed by that platform's rules.

8. Data Security and Retention

We use reasonable administrative, technical, and physical safeguards to protect your information, including password protection, two-factor authentication on key accounts. No method of transmission or storage is completely secure, so we can't guarantee absolute security.

We keep personal information only as long as needed for the purposes above and to meet legal, tax, and contractual obligations. Signed contracts and payment records are generally kept for 7 years. Images are kept as described in Section 4. Newsletter information is kept until you unsubscribe.

9. Your Choices and Rights

You may contact us at any time to:

  • Ask what personal information we hold about you;

  • Correct information that is inaccurate;

  • Request deletion of your information or images, subject to what we must keep for legal, tax, or contractual reasons, and any copyright or license terms in your session agreement;

  • Withdraw a model release going forward, as described in your release (we can't recall material already published or printed before you withdrew); and

  • Unsubscribe from marketing emails using the link in any email or by contacting us.

We'll respond within a reasonable time, generally within 30 days. If you live in a state with a consumer privacy law that gives you additional rights, we'll honor those rights as required by law, and you can use the contact details below to make a request.

10. Adults Only

Our Services and Site are intended only for people 18 and older. We do not knowingly collect information from anyone under 18, and we do not photograph minors for boudoir sessions. If you believe a minor has given us information, please contact us and we'll delete it.

11. Changes to This Policy

We may update this policy from time to time. When we do, we'll change the "Last updated" date at the top. If we make material changes, we'll take reasonable steps to let you know, such as posting a notice on the Site. Continued use of the Site after changes means you accept the updated policy.
